To achieve the project's goals, CreativeSparksAgency may require your cooperation and timely delivery of information. You agree to provide us with complete and accurate information and to inform CreativeSparksAgency of any changes to the information previously provided.
CreativeSparksAgency encourages users to share information about its website and services, but you agree not to imply that CreativeSparksAgency endorses or sponsors any third-party products or services. You agree not to use any copyrighted materials without obtaining prior written consent from the owner.
Unless otherwise agreed, invoices must be paid by bank transfer into CreativeSparksAgency’s designated bank account within 14 days of the invoice's date. Until full payment has been received, CreativeSparksAgency retains ownership of all work.
CreativeSparksAgency offers a Refund Policy to users who are unsatisfied with the services received. However, a refund will only be possible if the following conditions are met:
Unless otherwise specified, CreativeSparksAgency’s estimate does not include third-party costs beyond CreativeSparksAgency’s area of expertise. CreativeSparksAgency may seek out such specialized services unless directed otherwise by the user. The price of such services will be quoted in accordance with the cost to CreativeSparksAgency and passed through to the user.
CreativeSparksAgency will provide clients with a scoping document describing the project's functionality, including marketing services. Any modifications that go beyond the scope of the scoping document will be treated as a new project and charged accordingly when authorized by the client.
It is the user's responsibility to provide CreativeSparksAgency with the necessary details regarding the company's marketing and commercial goals. CreativeSparksAgency disclaims any liability for inaccuracies in content provided by the user. Any resulting adjustments may be subject to regular rates of charge.
The user authorizes CreativeSparksAgency to use the company's logos and other identifying marks in developing the project. The user agrees to defend CreativeSparksAgency against any legal action brought against it because of the user's carelessness or failure to secure the necessary copyright authorizations for all supplied content.
CreativeSparksAgency will maintain the privacy of the user's data and business dealings unless required by law or authorized by the user. However, CreativeSparksAgency has the right to reveal the user's information to third parties if necessary to protect its legal rights, to comply with a legal obligation or a court order, or to prevent a crime or a security breach.
Users are responsible for maintaining the confidentiality of their account information, including passwords and login credentials. CreativeSparksAgency will never ask for a user's password or login credentials through email or any other unsolicited communication.
In the event of a data breach or unauthorized access to user data, CreativeSparksAgency will take all necessary steps to notify affected users and authorities in accordance with applicable laws and regulations. Only legal uses are permitted for all services. You consent to defend CreativeSparksAgency and hold us free from any and all claims, damages, liabilities, and costs, including attorney’s fees, arising out of your use of our services, content, or website, or your violation of these Terms or any applicable law or regulation. CreativeSparksAgency shall be notified promptly of any such claims. CreativeSparksAgency may, at its own expense, assume the exclusive defense and control of any matter subject to indemnification by you. You will cooperate as reasonably requested by CreativeSparksAgency in the defense of any such claim.
Either party may terminate the engagement at any time by providing written notice to the other party. Upon termination, you shall immediately pay all outstanding fees and expenses, and CreativeSparksAgency shall transfer or provide you with any work product that has been completed and paid for.
